In a recent case the California Court of Appeals ruled in favor of rental property owners in stating that:"California law does not require rental property owners to participate in the Federal Section 8 program, and an owner''s refusal to participate in the program is not grounds for a discrimination action."
The tenant in the case of Sabi vs. Sterling argued that "current state law prohibits a landlord from discriminating based upon a tenant''s "source of income." The court ruled that as the US Congress initially intended in the legislation, enrollment in the Section 8 program is voluntary, and not required.
As with all things, a property owner should be able to choose what programs they enroll in, and not be forced to do so on the whim of a tenant.
