As property owners, property managers, and tenants, we have all dealt with a neighbor who has a barking dog they will not bring in, or quiet down, at one point or another. The first and best option is to contact the neighbor or tenant with the dog and try to reason with them. But when this doesn't work, what do you do??
At Pacific Shore Property Management we recently encountered a situation such as this at one of our Echo Park Rentals. After repeated letters and call went unanswered and the problem persisted, bothering our good tenants to no end, we took the next step and contacted Los Angeles Animal Services. In Los Angeles:
It is against the law for a dog owner, or anyone in control or custody of a dog, to allow the dog to make excessive noise, after receiving a legal notice of the noise complaint and a request to make it stop. The term “excessive noise” means noise which is unreasonably annoying, disturbing, offensive, or which unreasonably interferes with the comfortable enjoyment of life or property of one or more persons occupying property in the community or neighborhood. This law does not apply to a commercial animal establishment with a legal permit. (LAMC 53.63)
We filed a complaint, and the problem quickly went away as the neighbor began to bring in the dog at night so it wouldn't bark. When people are confronted with city departments threatening fines, and other serious actions, they quickly take heed apparently. In the end we resolved the problem for our tenant, and actually improved the dogs life (now he gets to sleep inside, which is probably what he wanted in the first place!).
